Senior Associate

James specialises in patent, Standard Essential Patents (SEP) and FRAND litigation across all areas of technology, but with a specific focus on the High Tech and telecoms fields.

In addition to his deep experience in the English courts, in which he has led on cases at all levels of the judicial system from the Comptroller all the way up to the Supreme Court, James brings a truly international perspective to tech litigation. He has spent time based in the firm’s Silicon Valley office as well as acting in cases before the Unified Patent Court, the European Patent Office and the national Courts of Germany, France, Finland, Norway, Sweden and Ireland. 

James also has a busy Trade Secrets and Breach of Confidence practice, which includes advising on the IP aspects of large team moves, obtaining and enforcing imaging orders and copyright issues relating to software. 

James has spoken at international conferences on the subject of jurisdictional challenges facing the resolution of global telecommunications, FRAND and SEP disputes. 

His recent work includes patent infringement and validity proceedings relating to adaptive bitrate video streaming, LED lighting special effects for film and television, laser based countermeasures against heat-seeking missiles and a number of technical trials relating to UMTS and LTE wireless technologies. He is currently working on a large and long-running Trade Secrets matter which includes allegations of breach of confidence and copyright infringement in the context of a large team move. 

James has a passion for the High Tech field and has advised on some of the biggest, most complex and globally high profile pieces of litigation in the sector.

Representative matters

  • A US-based television and direct-broadcast satellite provider in patent infringement and validity proceedings relating to adaptive bitrate video streaming in the UPC, Germany and UK.
  • A global semiconductor company on their potential claims for patent infringement against a key competitor and/or one or more of its customers in relation patents for semiconductor chips.
  • A series of SEP and FRAND disputes in the UK, including claims by Conversant, InterDigital, IP Bridge and MediaTek. The cases have involved both technical trials of infringement and validity of patents relating to cellular technology, as well as FRAND trials dealing with economic evidence as to appropriate royalty rates.
  • A global software developer in the financial services industry in proceedings for breach of confidence and copyright infringement.
