Agustina specializes in commercial and investment treaty arbitration

She has acted for a broad range of clients in disputes across multiple jurisdictions, under arbitration rules including ICSID, ICC, LCIA, SCC and UNCITRAL, and spanning sectors such as energy, oil and gas, mining, infrastructure and financial services.

Agustina has also advised at the pre‑contentious stage and during settlement negotiations in complex cross‑border litigation, and on matters relating to risk management, investment structuring, the setting aside and enforcement of awards, and the acquisition of contentious assets.

She has been recognised as a leading female arbitration lawyer in the 2025 Jus Connect Power List.

  • More than 30 different international investors in 10 separate ICSID and UNCITRAL arbitration claims against the Kingdom of Spain under the Energy Charter Treaty relating to the regulation of the Spanish renewable energy sector and involving claims worth in excess of EUR3.5 billion.
  • An EU Member State in an UNCITRAL investment treaty arbitration relating to EU restrictive measures adopted in the context of the Russia–Ukraine conflict.
  • Ukraine in an SCC arbitration brought by VEB.RF concerning sanctions and other measures allegedly imposed on Russian financial entities.
  • The Republic of Peru in two related UNCITRAL arbitration proceedings against The Renco Group concerning a mining facility. 
  • China National Petroleum Corporation International (CNPCI) in an LCIA dispute with a Latin American state‑owned company concerning an oil refinery.
  • A Czech transport company in an ICC arbitration seated in Madrid regarding breaches of competition clauses.

Pro bono

  • Advising Gentium on a joint programme with Universidad Pontificia Comillas (ICADE) to prepare a memorandum on human rights violations against rural workers in Spain.
  • Advising the Human Rights Law Firm Association on the legal defense of displaced communities in Guatemala, recognised by the Cyrus R. Vance Center for International Justice with its Award for Pro Bono Excellence.
